Acceptance of these terms

These Terms of Service ("Terms") govern your access to and use of PinMine-ai.com, including the web app at pinmine-ai.com and any related services we provide (the "Service"). By creating an account, logging in, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

The Service is offered by PinMine-ai.com ("we," "us," or "our"). You represent that you are at least 13 years old (or the age of digital consent in your country) and are legally able to enter into a binding contract. If you use the Service on behalf of a business, you confirm that you have authority to bind that business to these Terms.

Your account

You must provide accurate, current, and complete information when you register, and keep your account credentials secure. You are responsible for all activity that occurs under your account and for notifying us of any unauthorized use.

We may suspend or close accounts that are inactive for an extended period, that violate these Terms, or that create risk or liability for us or other users.

User content and uploads

You retain ownership of the product images, descriptions, affiliate links, and any other material you upload or submit to the Service ("User Content"). By submitting User Content, you grant PinMine-ai.com a worldwide, non-exclusive, royalty-free, limited license to process, copy, and display that content solely as needed to operate the Service and generate your marketing assets.

You confirm that you have all necessary rights to any User Content you submit, that it does not infringe the intellectual property, privacy, or other rights of any third party, and that it complies with all applicable laws. You are solely responsible for the User Content you provide.

Commercial rights to generated content

Content the Service generates from your User Content — including titles, captions, hashtags, and images ("Generated Content") — is assigned to you for your commercial and non-commercial use, subject to these Terms and to your ownership of the underlying User Content.

You may use, publish, modify, monetize, and distribute Generated Content in any media, including on Pinterest, Instagram, TikTok, Facebook, X, YouTube, and in paid advertising. Because Generated Content is produced by artificial intelligence, it may occasionally be derivative or similar to other works; you are responsible for reviewing it before commercial use.

We do not claim ownership of your Generated Content. We may use anonymized or aggregate data about generations to improve the Service, but we will not resell your specific Generated Content to others.

AI-generated content

The Service uses artificial intelligence to produce titles, descriptions, hashtags, and images. AI output can be inaccurate, biased, incomplete, or produce results that resemble existing works. You are responsible for reviewing every piece of Generated Content before you publish or rely on it.

We provide Generated Content "as is" and do not guarantee any specific marketing, traffic, engagement, sales, or commission results. You assume all risk associated with publishing or acting on Generated Content.

Affiliate links and disclosures

You are responsible for complying with the rules of any affiliate program you participate in — including Amazon Associates — and with applicable advertising and disclosure laws, such as the U.S. FTC Endorsement Guides (16 CFR Part 255). PinMine-ai.com formats your content but is not responsible for your compliance with these obligations.

To protect users from link abuse, the Service only accepts affiliate links that point to approved affiliate stores and networks. We may reject or remove links that do not meet these requirements. See our Affiliate Disclosure for how PinMine-ai.com's own affiliate relationships work.

Acceptable use

You agree not to:

• Upload or submit User Content you do not have the rights to use, or that is unlawful, deceptive, infringing, or harmful.
• Use the Service to create misleading, fraudulent, or unlawful marketing content, or content that violates a third party's rights.
• Submit affiliate links that redirect to domains outside the approved list, or attempt to bypass the link validation system.
• Attempt to access, disrupt, overload, or reverse-engineer the Service, its systems, or its underlying models.
• Resell, redistribute, or white-label Generated Content as a competing service without our written permission.
• Use the Service in any way that could damage, disable, or impair the Service, or interfere with any other party's use.

Plans, billing and refunds

The Service offers paid subscriptions (monthly and yearly) and one-time credit packs. Subscription fees are billed in advance on a recurring basis through our payment provider. One-time credit packs are billed once and do not renew.

Subscriptions: You can cancel your subscription at any time from your account. Cancellation stops future billing; your subscription remains active until the end of the current paid period, after which it downgrades to the free tier. We do not provide refunds or credits for partially used billing periods except where required by law.

Credit packs: One-time credit packs are non-refundable once a generation has been made using those credits. Unused credits remain available in your account until they are consumed.

If you believe you were charged in error, contact us through your account dashboard within 30 days of the charge and we will review your request. Where a refund is required by applicable consumer law, we will provide it in accordance with that law.

Intellectual property

The Service — including its name, design, software, models, and underlying technology — is owned by us and protected by intellectual property laws. These Terms do not grant you any right to use our names, logos, or trademarks except as needed to use Generated Content you have created.

Generated Content you create is yours to use for your marketing, subject to these Terms and your ownership of the underlying User Content.

Disclaimers

The Service is provided "as is" and "as available," with all faults. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that Generated Content will be accurate, lawful, or achieve any particular result. You use the Service and Generated Content at your own discretion.

Limitation of liability

To the fullest extent permitted by law, in no event will PinMine-ai.com be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Service or Generated Content — whether based on warranty, contract, tort (including negligence), or any other theory.

Our total aggregate liability for any claim arising out of or related to the Service is limited to the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or, if you have not paid us, to USD $50. This limitation applies even if a remedy fails of its essential purpose.

Termination

You may stop using the Service and delete your User Content and Generated Content at any time. You can close your account from your account settings.

We may suspend or terminate your access to the Service at any time, with or without cause, including if you violate these Terms or create risk or liability for us. Upon termination, your right to use the Service ends, but provisions that by their nature should survive (such as ownership, disclaimers, and limitation of liability) will remain in effect.

Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which PinMine-ai.com operates, without regard to conflict-of-law principles. We will try in good faith to resolve any dispute informally. If we cannot, disputes will be resolved in the courts of that jurisdiction, and you consent to its exclusive jurisdiction.

Changes to these terms

We may update these Terms as the Service evolves. We will update the "Last updated" date above and, for significant changes, will notify you in the app or by email. Your continued use of the Service after changes take effect means you accept the updated Terms. If you do not agree, you should stop using the Service and cancel any subscription.
